Terms of Service

The short version 🥔
Order a potato. We print and ship it. Don't ask us to print anything illegal or hateful. If something goes wrong, we'll make it right.
1. Who you're dealing with
These Terms govern your use of potatopost.lovable.app and any orders you place with PotatoPost GmbH, Friedrichstraße 100, 10117 Berlin, Germany ("PotatoPost"). By placing an order you accept these Terms.
2. Orders & contract
Adding a potato to the cart isn't an offer — your order is an offer to buy. The contract is formed when we send the order confirmation email. We may refuse any order at our discretion (e.g. for content reasons, see section 5).
3. Prices & payment
Prices are shown in Euro and include 19% German VAT. Shipping is calculated at checkout. We accept the payment methods shown at checkout (handled by Stripe). Payment is taken when the contract is formed.
4. Shipping & delivery
- Germany: 2–4 working days. EU: 4–7 working days. Priority halves it.
- Risk of loss passes to you on delivery to a consumer; on handover to the carrier for businesses.
- If a potato doesn't arrive within 14 days of dispatch, contact us and we'll send a replacement or refund.
5. What you can print (and what you can't)
You may print messages up to 40 characters. We will refuse, cancel, or refund any order that:
- incites hatred, violence or discrimination
- contains illegal content under German or EU law
- infringes third-party IP, trademarks or personal rights
- sexually depicts minors (zero tolerance)
- impersonates another person without consent
Inside jokes, swears, declarations of love and mild chaos are extremely welcome.
6. Right of withdrawal
Personalised potatoes are made to your specifications and are excluded from the 14-day EU right of withdrawal under § 312g (2) no. 1 BGB. Non-personalised items can be returned within 14 days in original condition. The withdrawal form is included in your dispatch email.
7. Warranty
Statutory warranty rights apply (2 years under § 438 BGB). If a potato arrives damaged or wrongly printed, email us within 14 days with a photo and we'll replace it or refund you, your call.
8. Liability
We are fully liable for intent and gross negligence, and under the German Product Liability Act. For slight negligence we are only liable for breach of essential contractual duties, and limited to foreseeable damages typical for the contract. Nothing here limits liability for injury to life, body or health.
9. Food-safety disclaimer
Our potatoes are real, edible German russets printed with FDA- and EU-approved food-grade ink. Store at room temperature, eat within 2–4 weeks. PotatoPost is not liable for spoilage caused by improper storage. If you have a potato allergy, please don't eat the potato (display it).
10. Intellectual property
All site content (text, images, logos) is © PotatoPost unless otherwise noted. You may not reuse it without our written consent.
11. Changes
We may update these Terms. The version in force at the time of your order applies to that order.
12. Governing law & disputes
German law applies (consumer protection in your country of residence remains unaffected). Place of jurisdiction for merchants is Berlin. The EU online dispute resolution platform is at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
